Purpose

Use Form 41-D to report administrative activity attributable to a person whose death is certified in the Official Record.

Death is a filing status. It is not a jurisdictional bar, and it does not close a record. The Bureau’s interest in the activity reported on this notice is limited to two questions: who was authorized to file on the decedent’s behalf, and whether the activity was authorized at all.

This notice does not restore, reinstate, revive, or reclassify the decedent. The Bureau does not perform restoration and administers no program under which restoration may be requested. A request for restoration will be recorded as received.

Who must file

File if:

  1. An account, subscription, membership, warranty, or obligation held in the decedent’s name has been renewed, extended, upgraded, or transferred.
  2. Correspondence has been issued over the decedent’s name.
  3. A document has been signed in the decedent’s hand after the certified date of death.
  4. A document has been signed in the decedent’s hand before the decedent’s approved lifespan began.
  5. The decedent has been recorded as present at a meeting, ceremony, hearing, or census.
  6. The decedent has been recorded as a survivor of another decedent.
  7. You are the executor, administrator, heir, employer, landlord, vendor, or records custodian of a decedent and have been asked to explain an entry.

Who must not file

Do not file if:

  1. The activity is a scheduled automatic payment that has not yet failed.
  2. The activity is a mailing addressed to a former occupant.
  3. The activity is the settlement of an estate under ordinary law.
  4. The decedent’s name appears on a building, a bench, a ship, a scholarship, or a street.
  5. The activity is a legal action brought in the decedent’s name by a living party who is identified.
  6. The only activity is that the decedent is remembered. Remembrance is not an administrative act.
  7. You remember the decedent as living. In that case file HAEB Form 22-R.

Filing deadline

  1. Within 45 days of the activity.
  2. Or within 45 days of the certified date of death, if the activity precedes it.
  3. Or within 45 days of the publication of this edition, if the activity precedes the edition.
  4. Activity that continues has no deadline, and the notice remains due.

Definitions

Decedent. A person whose death is certified in the Official Record.

Certified date of death. The date recorded in the Official Record. Where a family, a stone, and the Official Record disagree, the Official Record governs and the stone is not corrected.

Administrative activity. Any filing, payment, renewal, registration, signature, correspondence, appearance, or authorization attributable to a named person.

Attributable. Recorded under the person’s name. Attribution does not require participation.

Authorized activity. Activity completed by a person holding a documented authority to act.

Approved lifespan. The interval between the approved dates of birth and death as recorded in the Official Record.

Biographical overlap. A condition in which one person’s approved lifespan requires another’s to be extended.

Do not enter a legal name, address, date of birth, telephone number, government identification number, financial account, or password anywhere on this notice. The Bureau does not request them and cannot use them.

Section 4: Authorization

14. Attach the decedent's authorization for the activity reported in Section 3

Field 14 is required in all cases. The unavailability of the decedent is not an accepted basis for omission.

Section 5: Recurring obligations and renewals

Complete this section if the activity is a renewal, an extension, or a recurring charge.

Renewals are the most frequently reported activity under this notice. The Bureau does not cancel them.

A lifetime term selected in field 18 does not conclude on the certified date of death. The Division of Biographical Integrity has determined that the term refers to the term and not to the holder.

A filer who answers yes to field 21 and selects the second option in field 20 is a chronological nonresident for the purposes of that document and must also file HAEB Form 52-L. Continue completing this notice while doing so.

Section 7: Attestation

By submitting, I certify that:

  1. The activity is described as recorded.
  2. I have no reason to believe the decedent participated in the activity reported in Section 3.
  3. The activity reported in Section 3 could not have been completed without the decedent’s participation.
  4. I have not completed this notice at the decedent’s request.
  5. I am not seeking restoration of the decedent, and I understand that no such program exists.
  6. I will report further activity attributable to the decedent, including activity attributable to the decedent after my own certified date of death.

Consequence of filing or not filing

  1. There is no penalty for filing.
  2. Activity that continues after a notice is filed is recorded as continuing and does not require a second notice.
  3. A decedent with three or more unresolved activities is reclassified from DECEASED, CERTIFIED to DECEASED, NONCOMPLIANT. The reclassification has no effect on the decedent.
  4. A filer who does not file remains the filer.
  5. The Bureau does not pursue a decedent. It records that the decedent was pursued.

Privacy and records notice

HAEB is fictional and this form is satire. Nothing you type into this site is transmitted anywhere. No field on this page is submitted, stored, indexed, or read by any person or system.

This notice does not request the decedent’s legal name, address, date of birth, identification number, financial accounts, medical information, or cause of death. Do not enter any of them. The Bureau requires none of it, and a real collection of this kind would not require it either.

Within the fiction, a submitted notice is filed under the decedent’s record, which remains open, and under the filer’s record, which is opened.

Revision history

  1. Rev. 8.2. Original edition. Titled Notice of Posthumous Filing.
  2. Rev. 10.0. Retitled. The word posthumous was removed as prejudicial to the filing status.
  3. Rev. 12.1. Section 5 added following a review of periodical renewals.
  4. Rev. 12.4. Field 8 expanded from two options to four.

Filing instructions

  1. Complete one notice for each decedent. Do not consolidate a household.
  2. Complete Section 4 before Section 3.
  3. Do not send original documents. Do not send objects. An object recovered from an estate is declared on HAEB Form 17-B.
  4. If the decedent filed a Bureau form after the certified date of death, cite the receipt number of that form in field 11 and file this notice anyway.
  5. Retain one copy.
  6. Do not send a copy to the decedent’s last known address.

The following specimen is provided for guidance and reports no actual activity.

Bureau action on the specimen: notice accepted, field 14 recorded as outstanding, decedent reclassified, journal delivery continued.

The journal has since renewed twice more. Both renewals were reported by the same filer, who is no longer required to file.
